Terms of Use

Access to and use of MatchConsulting.com is subject to the terms and conditions set out below. None of the terms contained herein may be added to, modified, superseded or otherwise altered except in writing signed by both parties (including, but not limited to, in any details of assignment executed pursuant to this agreement).

Accepting the terms

By using MatchConsulting.com you agree to be legally bound by these terms, which shall take effect immediately on your first and continued use of MatchConsulting.com. If you do not agree to be legally bound by all of the following terms then please do not access and / or use MatchConsulting.com.

Accepting changes to terms

Match Consulting may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by Match Consulting. Your continued use of the Match Consulting site after changes are posted means you agree to be legally bound by these terms as updated and / or amended.

Use of Match Consulting

You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use MatchConsulting.com content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any MatchConsulting.com content except for your own personal, non-commercial use. Any other use of MatchConsulting.com content, including reposting, reprints and syndication rights, requires the prior written permission from an authorized Match Consulting representative.

Prohibited use of Match Consulting

You agree to use MatchConsulting.com only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else’s use and enjoyment of MatchConsulting.com. Prohibited behavior includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content or disrupting the normal flow of dialogue within MatchConsulting.com.

Confidentiality

Match Consulting acknowledges that it or its employees may, in the course of performing its responsibilities under this agreement, be exposed to or acquire non-public information which is proprietary to or confidential to the client or third parties to whom the client has a duty of confidentiality. Match Consulting agrees to hold such directly acquired information in strict confidence and not to disclose such information to third parties or to use such information for any purpose whatsoever other than in the provision services to the client as contemplated by this agreement and to advise each of its employees who may be exposed to such proprietary and confidential information of their obligations to keep such information confidential.  Upon termination of this agreement for any reason, or upon request of the client, Match Consulting shall, and shall procure that all its owners and agents shall, deliver up to the client all information, including but not limited to documents, forms, papers, designs, or other data containing proprietary or confidential information obtained by Match Consulting, its owners or agents, in performing the services and shall ensure that any such information stored electronically or in any other form is destroyed.  If requested by the client, Match Consulting shall certify to the client is compliance with this sub-clause.  This clause shall continue to apply after the termination of this agreement without limit in point of time but shall cease to apply to information which may come into the public domain otherwise than by breach of this clause.

No promotion

Match Consulting agrees that it will not, without the prior written consent of the client in each instance (i) use in advertising, publicity, or otherwise the name of the client or any partner, director or employee of the clients, nor any trade name, trademark, trade device, service marks, symbol or any abbreviation, contraction or simulation thereof owned by the client, or (ii) represent, directly or indirectly, that any product or any service provided by Match Consulting has been approved or endorsed by the client or any partner, director or employee of the client.  This provision shall survive termination of this agreement.

Data protection

Match Consulting shall ensure that each graduate candidate directed to the client (i) is aware that personal information about him or her, may be retained by the client for a reasonable period of time for potential employment purposes, as well as for more general human resources management purposes: (ii) is aware that his or her personal data may be transferred internationally throughout the client: (iii) is aware that the client may retain and use his or her personal information as described here irrespective of whether he or she is employed by the client (iv) consents to the treatment of his or her personal data in the manner described above: (v) is aware that prior to, on or after his or her date of hire, the client may conduct all background checks on him or her that are allowed by law: and verify his or her identity in any manner as may be determined by the clients in its sole discretion.

Personal details shall not under any circumstances be passed to a third party without the prior express written consent of the individual(s) concerned.  In the event the Match Consulting discovers personal details have been passed to an unauthorized party for marketing purposes or any other purposes not intended by MatchConsulting.com, then a representative of Match Consulting will immediately address the offending party with the possible suspension of the account.

Participating parties

Match Consulting holds the right to not accept any hiring firm(s) on the application to MatchConsulting.com on the basis of maintaining the credibility of the site and the sites’ participating clients. The Match Consulting also holds the right to withdrawal a participating hiring firm’s account if the primary nature of business advertised on the site changes beyond an acceptable category of industry.

Participating hiring firms will fall into any one, and possibly more, of the following industries: banking & finance, construction, consumer goods, engineering, health, industrials, leisure, media, natural resources, professional & support services, retailing, technology, telecoms, transport and utilities. The Match Consulting will not discriminate against a hiring firm’s application(s) based on the following information, recognized in the public domain: business strategy, products, financial status, directors or employees, or ranking within their respective industry.

Equal employment opportunity

Match Consulting provides equal employment opportunity access to all suitably qualified applicants without regard to race, colour, sex, national or ethnic origin, nationality, disability, marital status or any other impermissible criteria or circumstance.  Match Consulting represents that, in driving candidates to clients, it has not and will not discriminate on any such basis.  Further, Match Consulting agrees that, when performing its obligations under this agreement, it will comply with all applicable laws and regulations.

Term and termination

A client may immediately terminate this agreement at will at any time, with or without cause, by providing notice thereof to Match Consulting. Match Consulting may terminate this agreement with or without cause upon thirty (30) days’ prior notice to the client provided, however, the client has an opportunity to cure such cause during such period.

Consideration

MatchConsulting.com is a commercial enterprise where consideration, outlined in the contract between the Match Consulting and client, is exchanged in advance for services rendered.  In the event an account is withdrawn due to a client’s failure to uphold the terms & conditions, a refund shall not be provided. Clients are free to voluntarily withdrawal from MatchConsulting.com at any point after commencing the contract, but will not be entitled to a refund.

Disclaimers and limitation of liability

MatchConsulting.com content, including the information, names, logos, images, pictures and icons regarding or relating to Match Consulting, its products and services (or to third party products and services), is provided ‘as is’ and on an ‘is available’ basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

Under no circumstances will Match Consulting be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of MatchConsulting.com regardless of the form of action.

Match Consulting does not warrant that functions contained in MatchConsulting.com content will be uninterrupted or error free, that defects will be corrected, or that MatchConsulting.com or the server that makes it available are free of viruses.  Match Consulting does not warrant that functions contained in MatchConsulting.com content will provide a set quota of candidate traffic to a client’s careers portal, or that the candidate traffic will yield a quota of successful placements.

Intellectual property

The names, logos and identifying Match Consulting and / or third parties and their products and services are subject to copyright, design rights and trademarks of Match Consulting and / or third parties. Nothing contained in these terms shall be construed as conferring by implication, estoppels or otherwise any license or right to use any trademark, patent, design right or copyright of Match Consulting or any other third party.

Applicable law

This agreement shall be governed by and construed in accordance with English law and shall be subject to the exclusive jurisdiction of the English courts.
